Overview
These terms govern the Hop mobile app operated by Thais Rodríguez Coso (the “Service Provider”). By downloading or using the Application, you accept these terms and should read them carefully.
License to Use
The Service Provider grants a limited, non-exclusive, non-transferable, revocable license to install and use the Application on a mobile device. Prohibited actions include reproduction, distribution, modification, reverse engineering, decompilation, and disassembly.
Intellectual Property
The Service Provider retains all intellectual property rights in the Application. Users cannot use the Service Provider's trademarks, logos, or branding and must not remove or alter copyright notices.
Termination
The Service Provider may suspend access for material breaches, providing 14 days to cure if possible. Immediate suspension without notice occurs for law violations, intellectual property infringement, or harmful activity. Upon termination, users must delete all copies.
Age Requirements
Users must be at least 4 years of age (the age of digital consent in their jurisdiction). Parents or guardians must accept these terms for younger users.
User-Generated Content and Acceptable Use
Prohibited content includes illegal material, intellectual property violations, abusive language, hate speech, discrimination, spam, malware, privacy violations, deceptive content, and explicit violence or sexual content without proper age-gating.
The Service Provider reserves the right to remove content, suspend accounts, cooperate with law enforcement, and moderate material. Reports may be submitted to thaisrc@proton.me with sufficient identifying information.
By submitting content, users grant a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, prepare derivative works of, display and perform the content. Users represent they own or control all rights in posted content.
Application Modifications and Charges
The Service Provider reserves the right to modify the Application and charge for services. All charges will be clearly communicated.
Security and Device Responsibilities
Users are responsible for maintaining mobile device security and application access. Jailbreaking or rooting devices may expose devices to malware and cause application malfunctions.
Third-Party Services
The Application uses RevenueCat services (see their terms).
Internet and Data Responsibility
The Service Provider is not responsible for application functionality due to lack of Wi-Fi or exhausted data allowances. Users accept responsibility for mobile provider charges, including roaming fees when using the application outside their home territory. Device battery maintenance is the user's responsibility.
Limitation of Liability
The Service Provider is not liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, data loss, or business interruption. Full liability is retained for death, personal injury from negligence, and fraud. Liability is capped at amounts paid in the preceding 12 months or the minimum required by law.
Indemnification
Users agree to indemnify the Service Provider for breaches and misuse claims, excluding claims from the Service Provider's own negligence or violations.
Application Updates
Users must accept updates to continue using the Application. The Service Provider may cease support for earlier versions and may terminate the application at any time without notice.
Governing Law and Jurisdiction
These terms are governed by the jurisdiction where the Service Provider is established, excluding conflict of law rules except where mandatory consumer protection laws apply.
DSA Compliance
If the Application qualifies as an intermediary service under the Digital Services Act (EU Regulation 2022/2065), these provisions apply:

Content Moderation
Users receive clear statements when access is restricted or accounts are suspended, including the nature, legal basis, and redress options.
Notice and Action
Notices of illegal content are processed promptly without automated decision-making where human review is necessary. Decisions are communicated without undue delay.
Out-of-Court Dispute Settlement
Content moderation disputes may be submitted to certified dispute settlement bodies.
Transparency Reporting
The Service Provider publishes periodic transparency reports on moderation activities, available upon request.
Severability
Invalid provisions are modified to the minimum extent necessary, with remaining terms remaining enforceable.
Entire Agreement
These Terms and Conditions, with the Privacy Policy, constitute the complete agreement, superseding prior agreements.
Changes to Terms
The Service Provider may update terms periodically. Users should review this page regularly. Previous versions are available upon request.
